Show/breeder contract

If the cat has been purchased for breeding/showing, we will categorize its breeding quality and predict its show potential but we are unable to guarantee its show success. Cat/kitten being sold as a Breeder/Show is for the exclusive use in the Buyer's breeding program. The Buyer agrees this cat/kitten will never be leased or sold to another cattery or individual, nor will it be sent to another cattery or individual for stud service or to be used at stud. The Buyer agrees that under no circumstances will this cat/kitten be placed with any other individual or cattery for the purpose of breeding. The Buyer agrees this cat/kitten will never be co-owned with anyone outside of the buyer's immediate household other than Patlen (Patsy Bowman), hereafter referred to as Sellers and the Sellers deem this option of retaining co-ownership with the Buyer of this cat/kitten to be necessary. Any situation in which this cat/kitten does not reside with the Buyer at their residence will be interpreted as a direct violation of this clause and the Seller is released from any and all guarantees and obligations of this contract. The Buyer however, is not released from complying with the other clauses contained in this contract including but not limited to payment of the full purchase price. Any monies previously paid to the Seller will not be refunded to the buyer. If for any reason, at any time after the Buyer takes possession of the cat/kitten, they no longer desire to keep this cat/kitten in their breeding program, the Seller has the first right of refusal to repurchase this cat/kitten. The repurchase price will be the original selling price less 10% per year for each year the Buyer has possession of the cat/kitten. If the seller chooses not to repurchase this cat/kitten, the Buyer agrees the cat/kitten must be spayed/neutered before being placed in any other home or cattery for any reason and the Seller is not required refunding any monies. Any and all guarantees and responsibilities of the seller related to health, including refunds and or replacement of this cat/kitten are strictly between the undersigned Seller and Buyer and are not to be considered transferable to any third party. The Buyer is required to notify the seller prior to altering and placing the cat/kitten in any other home or cattery. By signing this contract, I am in full agreement with all of the above terms. In the event I violate this agreement the damages of $5,000 plus legal fees shall be payable to Patsy Bowman. Sole jurisdiction and venue for any legal dispute shall be in the State of Indiana, County of Washington . I have read the above , all of which I understand and accept. This written agreement is the entire agreement between the purchaser and the seller listed below. The purchaser will not rely on any verbal statements particularly about cash refunds or payments of veterinarian .
